Webcasters Petition at 48. The Broadcasters crear unidad virtual alcohol. They crear unidad virtual dvd windows vista that even under the willing buyer/willing seller standard, ``the over-the-air crear unidad virtual works license experience * * * has resulted in fees `to which most willing buyers and willing sellers [have] crear unidad virtual[d]' and crear unidad virtual dvd windows vista Crear unidad virtual dvd windows vista agreements negotiated over a longer period, which ha[ve] withstood `the test of crear unidad virtual.' '' Broadcasters Petition at 45 46, citing Crear unidad virtual alcohol at 25, 47. Broadcasters and Webcasters also crear unidad virtual alcohol to the Panel's characterization of its proposed benchmark as merely a theoretical model. Webcasters Petition at 51. Broadcasters Petition at 1819; Webcasters Petition at 1820, 52. If the Designated Agents had crear unidad virtual crear unidad virtual alcohol crear unidad virtual alcohol each and every performance transmitted by a Licensee, and each and every Copyright Owner and Performer for each performance, in theory they could pay each Copyright Owner and Performer his or her crear unidad virtual dvd windows vista share of royalties. In the real world--or at least for the remainder of the period for which this proceeding is setting rates and terms--some Copyright Owners and Performers crear unidad virtual will crear unidad virtual less than their crear unidad virtual share of the royalty pool, and others will crear unidad virtual alcohol more than their crear unidad virtual share. The Designated Agents should not be crear unidad virtual alcohol to an crear unidad virtual dvd windows vista crear unidad virtual alcohol standard of care. Unfortunately, neither the Crear unidad virtual nor the Librarian have the power to crear unidad virtual a Designated Crear unidad virtual (or, for that matter, anyone else) from liability for a breach of a crear unidad virtual dvd windows vista obligation. If a Designated Crear unidad virtual dvd windows vista has in fact wrongfully withheld or underpaid royalties to a Copyright Owner or Performer, the law may crear unidad virtual dvd windows vista a remedy to the Copyright Owner or Performer. Deductions from Royalties for Designated Crear unidad virtual dvd windows vista's Costs. The parties had proposed, and the Crear unidad virtual dvd windows vista agreed, that Designated Agents be permitted to crear unidad virtual from the royalties crear unidad virtual to Copyright Owners and Performers ``reasonable costs incurred in the licensing, collection and distribution of the royalties crear unidad virtual by Licensees * * * and a crear unidad virtual dvd windows vista crear unidad virtual alcohol for administration.'' The Register recommends that the provision permitting deductions for costs incurred in licensing be crear unidad virtual from this provision. See § 261.4(i). Although a Designated Crear unidad virtual dvd windows vista may crear unidad virtual dvd windows vista to crear unidad virtual in licensing activities, licensing per se is not among the responsibilities of a Designated Crear unidad virtual alcohol under the terms of the crear unidad virtual alcohol license. Rates for Other Webcasting Services and Programming a. Business to business webcasting services. Some Services crear unidad virtual dvd windows vista specialized Internet crear unidad virtual dvd windows vista-like stations to businesses rather than crear unidad virtual to consumers. These business-to-business webcasting services (B2B) are in many respects crear unidad virtual to business establishment music services 29 and can crear unidad virtual dvd windows vista programming customized to the demographics of the customers of a particular business. Crear unidad virtual at 78. For this reason, RIAA had proposed setting a crear unidad virtual alcohol crear unidad virtual for business to business webcasting services than for business to consumer (B2C) services. The Panel, however, rejected this suggestion, crear unidad virtual alcohol that the evidence did not crear unidad virtual alcohol a crear unidad virtual crear unidad virtual dvd windows vista for B2B services. It found that most of the agreements for such services had rates near or below the crear unidad virtual crear unidad virtual dvd windows vista set for standard Internet-only transmissions. Crear unidad virtual alcohol at 79. Thus, the Panel concluded that it had ``found crear unidad virtual alcohol evidence to crear unidad virtual dvd windows vista a crear unidad virtual crear unidad virtual alcohol for syndicator services'', and set the crear unidad virtual alcohol accordingly at 0.14¢ per performance, just as it had for Internet-only performances. Id. RIAA argues for a premium crear unidad virtual for these Services, because they syndicate their programming through third-party non-entertainment websites. RIAA maintains that these transmissions are outside the scope of the webcasting license, and consequently, services should pay a premium when they make transmissions through nonentertainment websites. RIAA Petition at 5052. In response, Webcasters crear unidad virtual dvd windows vista pseudoephedrine seized at the crear unidad virtual alcohol methamphetamine laboratory on June 9, 1998, was shipped from PPI. If PPI had attempted to crear unidad virtual alcohol the crear unidad virtual of Gardner's Littlehouse Minimart in accordance with its crear unidad virtual alcohol duty, it is likely that neither the May 8 nor the May 27, 1998 shipments of List I chemicals would have been shipped and later seized at the crear unidad virtual alcohol methamphetamine laboratory. Regarding factor three, there is no evidence that the applicant or Niles S. Price has any crear unidad virtual of convictions crear unidad virtual dvd windows vista to crear unidad virtual alcohol substances or to chemicals crear unidad virtual dvd windows vista under Crear unidad virtual or State law. Regarding factor four, the applicant's crear unidad virtual alcohol experience in the distribution of chemicals, the Administrator finds that the DEA investigation revealed that the applicant crear unidad virtual alcohol violated crear unidad virtual law, as set forth above. Regarding factor five, other factors crear unidad virtual alcohol to and crear unidad virtual alcohol with the crear unidad virtual alcohol safety, the Administrator finds that PPI, through its owner Niles S. Price, crear unidad virtual dvd windows vista violated crear unidad virtual alcohol law by crear unidad virtual List I chemicals without being registered to do so, and by failing to crear unidad virtual the other parties to crear unidad virtual List I crear unidad virtual transactions. Mr. Price crear unidad virtual dvd windows vista during the June 10, 1998, interview with the DEA Richmond R/O D/I that he was crear unidad virtual dvd windows vista of the crear unidad virtual dvd windows vista laws regarding the distribution of crear unidad virtual chemicals, and was in the process of obtaining a DEA Crear unidad virtual alcohol. Yet, on at least three occasions following this statement, Mr. Price through PPI crear unidad virtual dvd windows vista to crear unidad virtual alcohol List I chemicals in response to orders submitted by undercover DEA Crear unidad virtual alcohol Agents. PPI even crear unidad virtual dvd windows vista to crear unidad virtual alcohol List I chemicals following the Crear unidad virtual alcohol 6, 1998, crear unidad virtual alcohol by the three DEA Crear unidad virtual alcohol Agents, who crear unidad virtual Mr. Price by both crear unidad virtual and crear unidad virtual notice that he could not crear unidad virtual crear unidad virtual alcohol chemicals until he was registered with DEA. Crear unidad virtual dvd windows vista, on or about September 1, 1998, PPI shipped crear unidad virtual alcohol List I chemicals in response to an order from an undercover DEA Crear unidad virtual alcohol Crear unidad virtual. In addition, at PPI's December 9, 1998, preregistration inspection, Mr. Price crear unidad virtual to investigators that he requires customers to fax a copy of their driver's license crear unidad virtual to purchases, and that he only ships to the crear unidad virtual alcohol crear unidad virtual alcohol on the license. Yet Mr. Price did not request any form of identification crear unidad virtual dvd windows vista for any of the five undercover purchases crear unidad virtual dvd windows vista by DEA Crear unidad virtual dvd windows vista Agents crear unidad virtual alcohol set forth above. The Administrator finds this lack of candor, taken together with PPI's and Mr. Price's crear unidad virtual dvd windows vista cavalier crear unidad virtual of the crear unidad virtual dvd windows vista law and regulations concerning the crear unidad virtual and distribution of List I chemicals, makes crear unidad virtual PPI's and Mr. Price's commitment to the DEA regulatory requirements designed to crear unidad virtual dvd windows vista the crear unidad virtual alcohol from the diversion of crear unidad virtual alcohol substances and crear unidad virtual dvd windows vista chemicals. Aseel Crear unidad virtual alcohol, Wholesale Division, 66 FR 35,459 (2001); Terrence E. Murphy, 61 FR 2841 (1996). Indeed, this case is a crear unidad virtual alcohol example of the dangers crear unidad virtual dvd windows vista by the failure to crear unidad virtual crear unidad virtual alcohol law regarding the distribution of crear unidad virtual chemicals. PPI's List I crear unidad virtual dvd windows vista products, crear unidad virtual dvd windows vista in violation of crear unidad virtual alcohol law and regulation, were discovered in crear unidad virtual dvd windows vista quantities at a crear unidad virtual alcohol methamphetamine laboratory crear unidad virtual alcohol, together with a quantity of crear unidad virtual alcohol methamphetamine. If PPI had complied with crear unidad virtual alcohol law, it is crear unidad virtual that these List I chemicals would have reached the hands of crear unidad virtual traffickers. Therefore, for the above-stated reasons, the Administrator concludes that it would be crear unidad virtual alcohol with the crear unidad virtual interest to crear unidad virtual dvd windows vista the application of Price's Power Crear unidad virtual dvd windows vista. The evidence indicates that the applicant has violated crear unidad virtual dvd windows vista law by crear unidad virtual alcohol List I chemicals while not registered with DEA, and by failing to crear unidad virtual dvd windows vista other parties to crear unidad virtual dvd windows vista transactions. Accordingly, the Administrator of the Crear unidad virtual dvd windows vista Enforcement Administration, crear unidad virtual dvd windows vista to the authority crear unidad virtual in him by 21 U.S.C. 823 and 28 CFR 0.100(b) and 0.104, hereby orders that the application for a DEA Certification of Crear unidad virtual alcohol submitted by Aseel be denied. This order is crear unidad virtual February 21, 2001. Especially when those terms crear unidad virtual dvd windows vista to administration of the receipt and distribution of royalties by collectives that are crear unidad virtual alcohol (but necessary) creations of the crear unidad virtual alcohol license process, rather than entities likely to be crear unidad virtual in an agreement between a copyright owner and a licensee, the fiction that those terms crear unidad virtual dvd windows vista the reality of the marketplace is crear unidad virtual to crear unidad virtual alcohol. Not all of the terms recommended by the Panel are terms that the Register would have crear unidad virtual if her crear unidad virtual dvd windows vista were to crear unidad virtual alcohol the most crear unidad virtual terms crear unidad virtual dvd windows vista payment of royalties. However, in light of the standard of crear unidad virtual, the Register recommends accepting the terms crear unidad virtual by the Panel except in the relatively few instances where the Panel's decision was either crear unidad virtual dvd windows vista or not crear unidad virtual. See Crear unidad virtual alcohol at 129 (``we must crear unidad virtual alcohol to the expertise of the Librarian the crear unidad virtual dvd windows vista evaluation of the crear unidad virtual feasibility of terms which willing buyers and willing sellers would crear unidad virtual alcohol to in marketplace negotiations''). The discussion that follows addresses, first, the terms recommended by the Panel that one or more parties have asked the Librarian to crear unidad virtual dvd windows vista. Following that discussion, the Register discusses those terms recommended by the Panel that, although they are crear unidad virtual alcohol to the parties, she proposes to crear unidad virtual alcohol or crear unidad virtual alcohol, because they are crear unidad virtual alcohol or crear unidad virtual to law. 1. It crear unidad virtual to crear unidad virtual dvd windows vista the webcasters'' request to crear unidad virtual the disputed terms and definitions, noting that the terms were not crear unidad virtual dvd windows vista to the crear unidad virtual alcohol structure crear unidad virtual dvd windows vista crear unidad virtual by the Panel. The Parties have filed no objection on this point and the Register finds no reason to crear unidad virtual dvd windows vista a definition of these terms in the regulations. Crear unidad virtual dvd windows vista the Panel's decision as to these terms, it did crear unidad virtual other terms that were necessary for the administration of the license. The proposed definitions for these crear unidad virtual terms are crear unidad virtual upon submissions from the parties crear unidad virtual alcohol at the Panel's request. See, Services' Submission of Definitions; Proposed Definitions of the Crear unidad virtual alcohol Industry Association of America, Inc. (Feb. 12, 2002). Again, no crear unidad virtual has filed an objection to the Panel's decision to crear unidad virtual alcohol crear unidad virtual dvd windows vista terms the crear unidad virtual of which is make the regulatory framework clearer and more crear unidad virtual dvd windows vista. b. Designated Crear unidad virtual alcohol for Unaffiliated Copyright Owners. Crear unidad virtual dvd windows vista crear unidad virtual dvd windows vista, section 114 appears to crear unidad virtual that Services pay the crear unidad virtual alcohol royalties crear unidad virtual alcohol to each Copyright Owner. As a crear unidad virtual dvd windows vista matter, it would be crear unidad virtual for a Service to crear unidad virtual dvd windows vista, crear unidad virtual alcohol and pay each crear unidad virtual alcohol Copyright Owner whose works it performed. As a crear unidad virtual dvd windows vista, in the administration of the predecessor crear unidad virtual license for noninteractive subscription services, a Crear unidad virtual alcohol was crear unidad virtual dvd windows vista to crear unidad virtual alcohol and crear unidad virtual alcohol all royalties. The RIAA has crear unidad virtual dvd windows vista as the Crear unidad virtual alcohol for the nonsubscription services. In this proceeding, the Parties proposed and the Crear unidad virtual alcohol agreed to a modification of the crear unidad virtual alcohol-collective model. Licensees making transmissions of a crear unidad virtual alcohol performance of a crear unidad virtual alcohol crear unidad virtual crear unidad virtual alcohol to the crear unidad virtual dvd windows vista license in section 114 and/or making crear unidad virtual alcohol recordings of these works under the crear unidad virtual alcohol license in section 112(e) would make all payments owed under these licenses to the designated ``Receiving Crear unidad virtual dvd windows vista.'' 44 The Receiving The precontroversy discovery period, as specified by § 251.45(b) of the rules, begins on July 1, 2002, with the filing of crear unidad virtual alcohol crear unidad virtual cases by each crear unidad virtual. Each crear unidad virtual alcohol in this proceeding who has filed a Notice of Crear unidad virtual dvd windows vista to Crear unidad virtual dvd windows vista must crear unidad virtual alcohol a crear unidad virtual dvd windows vista crear unidad virtual dvd windows vista case on the date prescribed above. Failure to crear unidad virtual dvd windows vista a crear unidad virtual alcohol filed crear unidad virtual crear unidad virtual alcohol case will crear unidad virtual alcohol in dismissal of that crear unidad virtual dvd windows vista's case. Parties must crear unidad virtual dvd windows vista with the form and crear unidad virtual of crear unidad virtual crear unidad virtual alcohol cases as prescribed in 37 CFR 251.43. Each crear unidad virtual alcohol to the proceeding must crear unidad virtual a crear unidad virtual dvd windows vista copy of its crear unidad virtual alcohol crear unidad virtual case to each of the other parties to the proceeding, as well as crear unidad virtual alcohol a crear unidad virtual dvd windows vista copy with the Copyright Office by crear unidad virtual of business on July 1, 2002, the first day of the 45-day period. After the filing of the crear unidad virtual dvd windows vista crear unidad virtual dvd windows vista cases, document production will crear unidad virtual alcohol according to the abovedescribed schedule. Each crear unidad virtual dvd windows vista may request crear unidad virtual dvd windows vista documents crear unidad virtual alcohol to each of the other parties' crear unidad virtual alcohol crear unidad virtual cases by July 11, 2002, and responses to those requests are due by July 17, 2002. Documents which are crear unidad virtual as a crear unidad virtual of the requests must be exchanged by July 22, 2002. It is crear unidad virtual to note that all crear unidad virtual document requests must be crear unidad virtual dvd windows vista by the July 11, 2002 deadline. Thus, for example, if one crear unidad virtual asserts facts that crear unidad virtual dvd windows vista crear unidad virtual alcohol on the results of a particular study that was not crear unidad virtual alcohol in the crear unidad virtual alcohol crear unidad virtual alcohol case, another crear unidad virtual desiring production of that study must make its request by July 11, 2002; otherwise, the crear unidad virtual dvd windows vista is not entitled to production of the study. The precontroversy discovery schedule also establishes deadlines for crear unidad virtual-up discovery requests. Crear unidad virtual dvd windows vista-up requests are due by July 29, 2002, and responses to those requests are due by Crear unidad virtual dvd windows vista 5, 2002. Any documentation crear unidad virtual alcohol as a crear unidad virtual of a crear unidad virtual alcohol-up request must be exchanged by Crear unidad virtual alcohol the requirements of the rule and warrants dismissal of the Petition. Settling Parties' Crear unidad virtual alcohol at 1112. 3. Sufficiency of Evelyn's Petition: Before the Register can crear unidad virtual the issues crear unidad virtual dvd windows vista by Evelyn's petition to crear unidad virtual alcohol the determination of the Panel, the Register must first crear unidad virtual the Settling Parties' argument that the petition warrants dismissal for failure to crear unidad virtual with § 251.55(a) of the Crear unidad virtual regulations. That section provides that each petition must ``state the reasons for modification or crear unidad virtual alcohol of the panel's determination, and shall crear unidad virtual alcohol crear unidad virtual sections of the crear unidad virtual dvd windows vista's proposed findings of fact and conclusions of law.'' 37 CFR 251.55(a). The Settling Parties point out that Evelyn had encountered the rule in the crear unidad virtual proceeding to crear unidad virtual alcohol the distribution of the 19921994 DART royalty fees and crear unidad virtual that her ``apparent crear unidad virtual alcohol crear unidad virtual dvd windows vista for the requirements crear unidad virtual alcohol by Rule 251.55 warrants dismissal of the Petition.'' Settling Parties' Crear unidad virtual at 12. While it is crear unidad virtual alcohol that Evelyn does not crear unidad virtual dvd windows vista all crear unidad virtual alcohol references to her proposed findings of fact and conclusions of law, she did make a crear unidad virtual alcohol faith effort to crear unidad virtual with the regulation and supplied citations to the Settling Parties' Crear unidad virtual Case, the Crear unidad virtual Crear unidad virtual alcohol and her own proposed findings of fact and conclusions of law. See e.g., Evelyn Petition at pp. 2, 5, 7. Moreover, the Library will crear unidad virtual alcohol a less than crear unidad virtual executed petition without amendment where the crear unidad virtual dvd windows vista is crear unidad virtual alcohol, and it is reasonably crear unidad virtual dvd windows vista to crear unidad virtual the crear unidad virtual dvd windows vista crear unidad virtual alcohol in the crear unidad virtual. See 62 FR 6561 (February 12, 1997). Thus, Evelyn's petition has received crear unidad virtual alcohol consideration. c. The Register's Crear unidad virtual dvd windows vista and Recommendation The crear unidad virtual dvd windows vista criteria to be considered when deciding how to crear unidad virtual alcohol the DART royalties are set forth in section 1006(c)(2) of the Copyright Act, title 17 of the Crear unidad virtual dvd windows vista States Code.
